In the proposal that has been discussed and voted on today's Plenary, the City Council has revealed that the concessionaire has breached the specifications, and has committed faults declared to be very serious and serious.
These include not complying with the guidelines of the City Council in terms of the conditions of service provision, take more than five months without paying workers, and leave the children unheated during the last cold wave.
The intervention or hijacking of the concession is a legal figure contained in the Contract Law and in the Bidding Documents that allows the council to temporarily recover the direct management of the service, performing all the necessary actions to ensure the proper provision of the same, The appointment of an auditor by the City Council who will be the one who temporarily holds the economic and technical direction of the concession to, once the intervention has finished, to make an accounting balance and to demand from the company the expenses that would have incurred Administration on account of the intervention.
According to the Councilor for Finance, Carlos López, "intervention is the only way to ensure the provision of the service, without prejudice to minors and parents and guaranteeing the rights of women workers."
The company has 10 days to solve those very serious and serious faults in which it has incurred according to the Plenary and the reports that are held by the City, and if not, it will be again the Plenary that, in extraordinary session, determine the terms Of the intervention, the duration, the personnel responsible for it, etc.
The Councilor for Education, Conchi Martínez, stressed that "the focus is on minors, who would be most affected if the service ceased to be provided or continue in the current conditions, as we consider that they have the right To continue enjoying a kindergarten of 0 to 3 years with ALL the guarantees, as well as in their families, who are also allowed to reconcile family and work life until the end of this school year.
During the next weeks the City Council will hold meetings with the members of the Educational Community to convey the terms of the intervention.
